PROCESS TO REGISTER A COMPANY IN INDIA
A lot of people dream of going for business. Starting a new business is always challenging and exciting. The first and foremost thing you need to do for your start up to get recognized is to register your company.
You need to follow the following steps in order to register your company in India:-
1. File for DIN and DSC
Obtain Director Identification Number (DIN) from Form DIN-1 online and Digital Signature Certificate (DSC) from any of the six private agencies authorized by MCA-21. The prescribed application form shall be submitted along with the identity and address proof.
2. Apply online for company’s name
Approval for the name of the company can be done electronically. Check the availability of company’s name on MCA-21 website. 6 names can be submitted in totality, out of which 1 will be approved.
3. Stamp company’s documents
Company’s documents stamping should be accompanied by unsigned copies of the Memorandum and Articles of Association (MAA), and the payment receipt. The duly stamped, signed, and embossed copy is returned by the Superintendent.
4. Obtain Certificate of Incorporation
You need to get the Certificate of Incorporation for your company, the forms for which are filled online on the website of the Ministry of Company Affairs. The Certificate of Incorporation is automatically sent to the registered address of the company through mail after the completion of the procedure.
5. Get a seal for your company
Get your company a seal to issue share certificates and other documents.
6. Get a PAN
A PAN (Permanent Account Number) is necessary for company’s verification. Application for PAN is made using Form 49A.
7. Obtain a TAN
A Tax Account Number (TAN) needs to be filed using Form 49B and submitted at any TIN Facilitation Center.
8. Register with State/Municipal Establishment Act
According to the Establishment Act of the State or Municipality, a statement containing the employer’s and manager’s names and the establishment’s name, postal address, and category must be sent to the local shop inspector with the applicable fees.
9. Register for GST
You have to register for GST if the annual turnover of the company exceeds Rs. 20 Lakhs /-.
10. State Profession Tax Registration
According to Section 5 of the Profession Tax Act, register your company for the State Profession Tax using Form 1.
11. PF Registration
It is necessary to provide information to the concerned regional Provident Fund Organization (EPFO) in the prescribed manner for allotment of Establishment Code Number.
12. Medical insurance registration
Register your company by submitting Form 01 for the medical insurance of your employees.
